1. About this policy

This policy explains when and how you can cancel a service or request a refund from DiKarabo Technologies (Pty) Ltd ("DiKarabo", "we", "us"). It applies to the services and products you buy from us through this website or under a written agreement with us, and forms part of our Terms and Conditions.

We are based in South Africa. All transactions are in South African Rand (ZAR), and this policy is governed by South African law, including the Consumer Protection Act 68 of 2008 (CPA) and the Electronic Communications and Transactions Act 25 of 2002 (ECTA). Nothing in this policy limits or replaces any right you have under those laws. Where this policy and the law differ, the law applies.

2. What we provide

What you can cancel, and whether a refund is due, depends on which type of offering you bought:

  • Custom development and professional services — websites, web and mobile applications, system modernisation, and related digital services that we build or deliver to your requirements.
  • Subscription services — recurring services billed on a repeating cycle, such as maintenance and support plans and access to DiKarabo software products.
  • Once-off services and digital products — discrete services or digital items supplied for a single fee.

3. Your cooling-off right for online purchases

If you are a natural person and you enter into a transaction with us electronically, ECTA gives you a 7-day cooling-off period in which you may cancel without reason and without penalty. For services, this period runs from the date the agreement is concluded; for a digital product, from the date you receive it. If you cancel within this period, we refund what you have paid, less the direct cost (if any) of returning anything supplied to you.

This cooling-off right does not apply in the cases ECTA excludes. The exclusions that are relevant to what we do include:

  • services that have already begun with your consent before the seven days end (for example, where you ask us to start work straight away); and
  • software or digital content that has been accessed, downloaded, or unsealed.

Where an exclusion applies, your other rights in this policy — in particular your rights if the work is defective or sub-standard (section 6) — still apply in full.

4. Custom development and professional services

Because this work is built to your requirements, the following applies:

  • We may ask for a deposit or milestone payment before we begin. Deposits are not automatically forfeited if you cancel. If you cancel after work has started, we refund what you have paid less a reasonable amount for the work already done and for unavoidable costs or third-party charges we have committed to on your behalf. South African law does not allow a blanket "non-refundable" deposit, and we do not apply one.
  • If we are unable to supply an agreed service (for example, because of our own capacity), we refund you in full within 30 days.
  • If the work we deliver is not of the agreed quality, not fit for the agreed purpose, or not completed on time, you may ask us to put it right, or you may ask for a refund of a reasonable portion of the price, in line with the CPA. We do not charge you to correct our own errors.
  • Please send cancellation requests in writing (see section 7).

5. Subscription services

  • You may cancel a subscription at any time. Cancelling stops future billing; your access continues until the end of the billing cycle you have already paid for, and no further charges are made after that.
  • Once a billing cycle has started, we do not refund the remaining part of that cycle, except where the law requires it or where the service has failed (see section 6).
  • Subscriptions renew automatically at the end of each cycle unless you cancel before the renewal date. We make the renewal terms clear when you subscribe.
  • If you are a natural person on a fixed-term subscription, the CPA lets you cancel on 20 business days' written notice. A reasonable charge may apply for the unexpired portion of a fixed term; we do not apply an unreasonable penalty.
  • To cancel, follow section 7. When account self-service becomes available, you will also be able to cancel from your dashboard.

6. Faulty, defective, or non-conforming services and products

Whatever else this policy says, if a service or product is defective, unsafe, or materially not as described, you are entitled under the CPA to have it repaired or corrected, replaced, or refunded, as appropriate to the failure. These rights cannot be signed away. Please tell us about the problem as soon as you reasonably can so that we can put it right.

7. How to request a cancellation or refund

Email info@dikarabotechnologies.co.za and include:

  • your name and the account or project reference;
  • the service or product concerned;
  • the date of purchase and proof of payment; and
  • the reason for your request, where a reason is required.

We will acknowledge your request, tell you whether a refund is due and how much it is, and — where a refund is payable — process it to your original payment method within 30 days. Card and Instant Electronic Funds Transfer (EFT) refunds are returned through our payment processor, and how quickly the funds reach you depends on your bank.

8. Refunds and your payment method

We process online payments through a South African payment gateway. Approved refunds are returned to the payment method you used to pay. We do not store your full card details — these are handled by our payment processor on its own secure systems.

9. We do not waive your rights

We do not contract out of, or ask you to give up, any right that the CPA or ECTA gives you. Any part of this policy that conflicts with those Acts does not apply, to the extent of that conflict.

10. Changes to this policy

We may update this policy from time to time. The version published on this page is the current one, and the "last updated" date above shows when it last changed.
